The petitioner has filed the instant application for grant of regular bail in connection with Sahpur P.S. Case No. 162 of 2022 registered under section 366(A) of the Indian Penal Code. Prosecution case relates to abduction of the informant's daughter when she along with her daughter went for satsang ceremony, however, she returned home but her daughter did not return, on search she came to know that she fled away with the petitioner and took away some ornaments and 50,000/- cash from her house.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. When victim recovered, she

No.65452 of 2022(2) dt.25-02-2023 2/2 stated in her statement recorded under Sections 161 and 164 of Cr.P.C, that she fell in love with the petitioner and went with him Chennai out of her own sweet will and later on she solemnized marriage with the petitioner in the temple of Chennai which is apparent from the impugned order. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. He is languishing in judicial custody since 11.07.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sahpur P.S. Case No. 162 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned VI Additional Sessions Judge cum Special Judge (POCSO) Bhojpur at Ara.
