The petitioner has renewed his prayer for bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 56.4 litres of liquor was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 17.5.2022 (Annexure-1) passed in Cr. Misc. no. 68810 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner has remained in custody for more than one year since 4.10.2021. Heard learned AP.P for the State.

No.63569 of 2022(2) dt.23-11-2022 2/2 Having heard learned counsel for the parties and taking into consideration the nature of allegations, the liberty granted in the earlier order of rejection dated 17.5.2022 and the petitioner having remained in custody for more than 1 year since 4.10.2021, the petitioner is directed to be enlarged on bail in connection with Kateya P.S. Case no. 360 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise, Gopalganj.
