This is an application for anticipatory bail for the offences under Sections 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted on behalf of the petitioners that there is case and counter case and the only allegation against the petitioners is that they were pressing the neck of the informant and no allegation of firing is leveled against the petitioners. It has further been submitted on behalf of the petitioners that there is land dispute between the parties.

Patna High Court Cr.Misc. No.51401 of 2016 (2) dt.19-12-2016 that co-accused namely, Santu Singh @ Santu Kumar Singh and Ram Pukar Singh have been granted anticipatory bail by this Court by order dated 25.10.2016 in Cr.Misc.No. 42944 of 2016. Heard learned APP appearing for the State who could not controvert this fact.
Having heard both sides and in view of the fact that there is a case and counter case and there is land dispute between the parties and the co-accused persons have been granted anticipatory bail, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur in connection with Maner P.S. Case No. 167 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and further that the petitioners will cooperate with the investigation of the case as and when required by the police.
