1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Manjhi P.S. Case no. 62 of 2023, registered under sections 272, 273, 420 and 120B of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, on a container vehicle being stopped it is stated that 2312.280 litres of liquor was recovered and the driver disclosed that the liquor had to be delivered to the petitioner and one another.

4. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. The only material against him is the statement of co-accused made before police. The reason for

Patna High Court CR. MISC. No.66013 of 2023(2) dt.18-10-2023 2/2 false implication is his antecedents. He is in custody since 3.6.2023 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the submissions made, no incriminating article having been recovered from the petitioner's possession and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Manjhi P.S. Case no. 62 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-IInd, Saran at Chapra.
