2. The petitioner seeks bail in connection with Rajapakar P.S. Case No. 76 of 2025 registered for the offence under Sections 140(3), 103(1), 238, 61(2), 3(5) of the BNS.

3. As per the prosecution case, unknown criminals are said to have killed the deceased.

4. The petitioner is in custody since 9.3.2025.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and she has falsely been implicated in this case.

6. Learned counsel for the informant has opposed

No.63271 of 2025(2) dt.17-09-2025 2/3 the application of the petitioner and has submitted that petitioner is also involved in the killing of the deceased and if she has not been involved in the killing of the deceased then she should have informed the police about the same.

7. During investigation, the police went to the school of the cousin brother of the deceased namely Kunal Gautam where the blood marks were discovered. Thereafter, during investigation, it has come that the petitioner, Kunal Gautam and Manjay Paswan were on the place of occurrence with the deceased. During investigation, the petitioner and other co-accused have also given their self-inculpatory statement and from the same it appears that the petitioner was called by the other co-accused to cook meat. Thereafter, the deceased was called by Kunal Gautam and subsequently, he was killed by Kunal Gautam and Manjay Paswan and the petitioner is not involved in the killing of the deceased.

8. Considering the facts of the case and also considering the fact that petitioner is a woman, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the
