The petitioner is languishing in custody in a case registered for the offences punishable under Sections 498(A), 323, 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of torture for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.69958 of 2023(3) dt.10-01-2024 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the complainant. There is general and omnibus allegation against the petitioner. The petitioner has deposited a cheque of Rs. 1,28,000/- in the bank in the name of hs daughter in compliance of the order of this Court. The petitioner is suffering from mental illness and his treatment is going on in Central Institute of Psychistry, Kanke, Ranthi, the prescription of the petitioner has been annexed as Annexure-5 to the petition. The petitioner is languishing in custody since 05.07.2023. In contra, learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount

Patna High Court CR. MISC. No.69958 of 2023(3) dt.10-01-2024 3/3 each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bihar Sharif at Nalanda in connection with Complaint Case No. 317(C) of 2014.

The petitioner will appear on each and every date before the Trial Court. None appearance of the petitioner before the Trial Court on two consecutive occasions will give liberty to the Court below to cancel the bail bonds of the petitioner.
