Patna High Court MJC No.2699 of 2023(4) dt.19-03-2025 2/2 petition bearing MJC No. 5135 of 2018, which has stood dismissed on account of non-compliance of the peremptory order dated 20.7.2022.

The learned counsel appearing for the petitioners in the present petition submits that since the earlier counsel appearing for the petitioners had died, the defects could not be removed, however, the same would definitely be removed within a period of four weeks from today, hence, a sympathetic view be taken and the aforesaid petition be restored.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid petition bearing MJC No. 5135 of 2018 to its original file, subject to removal of defects as pointed out by the registry, within a period of four weeks from today. 4.

Accordingly, the present restoration petition stands disposed of on the aforesaid terms.
