JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 272 and 273 of the Indian Penal Code and 47A of the Excise Act.

Allegation is that 144 litres of country made liquor and 3 litres of foreign liquor was recovered from possession of petitioner.

It has been submitted on behalf of petitioner that he is in custody since 4.9.2016. Petitioner has got no criminal antecedent. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 144 litres of country made liquor and 3 litres of foreign liquor is said to have been recovered from possession of petitioner. No compliance of Section 100 of the Code of Criminal Procedure is made.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.52618 of 2016 (2) dt.08-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Bhojpur, Ara, in connection with Piro P.S. Case no. 24 of 2016.
