Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302 of the Indian Penal Code.
Petitioner is in the list of 51 accused persons named in the FIR. However, the assailants of the deceased are Anshur Rahman, Md. Kasim, Abdull Rahman, Md. Jamal, Safikur, Md. Iliyas and Habib. Petitioner is not the assailant. Learned counsel for the informant opposed the prayer for bail on the ground that in the past also for the land dispute criminal case was lodged by the informant-side. No.58988 of 2019(2) dt.27-09-2019 2/2 of commission of any overt-act by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jalalgarh Police Station Case No.46 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
