JUSTICE BIRENDRA KUMAR ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 120B read with Sections 420, 467 and 468 of the Indian Penal Code and Sections 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988.

Submission of learned counsel for the petitioner is that similarly situated some other co-accused has already been allowed anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 39977/2017 and in other criminal miscellaneous. Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.49588 of 2017 (2) dt.17-10-2017 2/2 of the order, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below, where the case is pending, in connection with R.C. Case No. 1(A)/2015, arising out of CBI Case No. RC0232015A0001/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
