30-08-2018 The petitioner has moved this court seeking following reliefs: - "(i) To issue an order/orders, direction/directions or writ in the nature of mandamus directing the respondent no. 1 to 8 to remove the four wheeler vehicle bearing Registration No. BR1Y-6842 by touching the grill gate of the petitioner lawyer's chamber situated on the ground floor of Block-A of Lakshmi Uma Plaza, Lohanipur East, P.S. - Kadamkuan, Town & District - Patna since 13.11.2016 obstructing the petitioner engress and outgress in his chamber.

(ii) To direct the respondent no. 7 to unlock the room of the petitioner which was installed by the respondent no. 9 after breaking the lock of the petitioner on 13.11.2016.

Patna High Court Cr. WJC No.1198 of 2016 (4) dt.30-08-2018 (iii) To take action against the respondent no.8, who is the investigating officer in the case by changing the respondent no. 8, who is in connivance with the respondent no. 9.

(iv) To any other relief or reliefs for which the petitioner is entitled."

In the nature of the controversies which have been brought to the notice of this court particularly appearing from the counter affidavit filed on behalf of respondent no. 2 to 7, this court does not find any reason to entertain the present writ application. The dispute seems to be inter se between the petitioner and the private respondent no. 9 who are co-sharers and the enquiries made by the police authorities on the complaint made by the petitioner has revealed that the nature of dispute between the parties are in the nature of a civil dispute. This court cannot go into such allegation in the present writ application.

This writ application is dismissed.

The petitioner, if so advised, may seek his remedy in an appropriate proceeding and in an appropriate jurisdiction in accordance with law.
