Heard learned counsel for the petitioner and learned counsel for the respondents.

The present application has been filed for modification of order dated 28.11.2017 passed in C.W.J.C. No. 25226 of 2013 by which the writ petition was disposed of with a liberty to the petitioner to prefer an appeal before the State Appellate Authority, challenging the order dated 16.06.2010 contained in Memo No.

Patna High Court MJC No.533 of 2018 (3) dt.18-05-2018 2/2 445 dated 09.07.2010 passed in Appeal No. 539/2009, order dated 03.12.2010 contained in Memo No. 1071 dated 08.12.2010 passed in Appeal No. 23/2010 and order dated 14.10.2011, contained in Memo No. 514 dated 19.10.2011 passed in Appeal No. 71/2011 by the Member, District Teachers Employment Appellate Authority, Bhojpur at Ara within a period of thirty days from the date of order i.e., 28.11.2017.

Learned counsel for the petitioner submits that due to some unavoidable reason, he could not prefer an appeal before the State Appellate Authority. Hence, he prays for further thirty days time to prefer an appeal before the State Appellate Authority. Considering the grounds mentioned in the application, the petitioner is granted further thirty days time to prefer an appeal before the State Appellate Authority from today. The order dated 28.11.2017 passed in C.W.J.C. No. 25226 of 2013 stands modified to the extent as indicated above. The modification application is, accordingly, allowed. U.K./- (Sudhir Singh, J) U
