2. This is the second attempt made on behalf the petitioner, who is apprehending his arrest in connection with Hisua P.S. Case No. 325 of 2024 for the offences punishable under Sections 147, 148, 149, 307, 323, 354, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. It is fairly contended that earlier the petitioner had approached this Court in Cr. Misc. No. 87549 of 2024 which came to be negated by a Bench of this Court vide
Patna High Court CR. MISC. No.64676 of 2025(3) dt.12-11-2025 2/3 order dated 19.12.2024. However, after the rejection of prayer for bail of the petitioner, one of the co-accused person, having identical allegation, has approached this Court Cr. Misc. No. 2312 of 2025 and he has been accorded with privilege of anticipatory bail. Referring to the aforenoted order, it is submitted that now under the changed circumstances, the petitioner has approached this Court for grant of anticipatory bail for reconsideration of the matter.

On the other hand, learned Advocate for the State and the informant, vehemently, opposed the bail application and submits that this fact of refusal to grant bail has not been brought to the knowledge of the co-ordinate Bench in Cr. Misc. No. 2312 of 2025, as it appears from the order itself. It is further contended that so far other accused persons are concerned, they have secured regular bail. The petitioner also bears four criminal antecedents besides the present one.
6. Regard being had to the submissions set forth by the learned Advocate for the respective parties and taking note of the materials available on record, this Court is not acceded to the prayer of the petitioner for grant of anticipatory bail, which had already been rejected earlier by
Patna High Court CR. MISC. No.64676 of 2025(3) dt.12-11-2025 3/3 this Court. Accordingly, the prayer for anticipatory bail stands rejected.
7. However, the petitioner is directed to surrender before the court below, preferably, within a period of four weeks from today, learned jurisdictional Court shall consider the submission of the petitioner that one another accused person has been granted anticipatory bail by this Court along with other materials available on record.
