The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

It is alleged that motorcycle along with a mobile of the informant was stolen by the accused persons, leading to registration of FIR against unknown. During investigation, the name of petitioner sprang up in the confession of Gautam Kumar, who suggested that this petitioner sold the alleged motorcycle to one Azad Rohit.

It is submitted by learned counsel for the petitioner that except the confessional statement of the co-accused, there is

Patna High Court Cr.Misc. No.54369 of 2015 (2) dt.01-12-2015 2/2 nothing on record. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Harnaut P.S. Case No.333 of 2014, pending before the learned CJM, Nalanda.

With the above observation, this application is, accordingly, disposed off.
