The petitioners seek bail in a case registered for offences punishable under sections 30 (a), and 38 of the Bihar Prohibition and Excise Act, 2016 and 182 of Motor Vehile Act. It is contended that, as per allegation, 260 litres of country-made liquor were recovered from a Bolero vehicle which was being driven by petitioner no. 1 and boarded by petitioner nos. 2 and 3. Petitioners claim that they are having clean antecedents and are in custody since 20.7.2017. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released

Patna High Court Cr.Misc. No.46690 of 2017(2) dt.21-09-2017 2/2 on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Aurangabad in connection with Mali P.S. Case No. 55 of 2017 with further conditions that one of the bailors of the petitioners must be the resident of State of Bihar.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
