JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that a bag containing Rs. 40,000/- to 45,000-/ was snatched by three miscreants. They also fired shot causing injury on his thigh and fled away.
It has been submitted on behalf of petitioner that he is in custody since 30.4.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is not named in the F.I.R. He has not been put on T.I.P. There is no recovery of any incriminating article from possession of the petitioner. Other co-accused have been granted bail vide Cr. Misc. no. 43640 of 2016 and Cr. Misc. no. 31865 of 2016.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

No.51301 of 2016 (2) dt.05-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Town P.S. Case no. 238 of 2016.
