JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Aurangabad (T) P. S. Case No. 203 of 2019, disclosing offences under Sections 30(a), 37(B) of the Bihar Prohibition and Excise Act, 2016.

Police on information of carrying of the huge quantity of liquor by petitioner and other accused persons, raided the place of occurrence, on seeing the police party, accused persons started fleeing away, but two persons were arrested and there is recovery of huge quantity of liquor from there. Petitioner is also named in the F.I.R.

Submission of the learned counsel for the petitioner is that except that police has got information about carrying of liquor by petitioner and other accused persons, there is absolutely nothing against this petitioner. He is not the owner of

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-VII-cum- Special Judge (Excise), Aurangabad, in connection with Aurangabad (T) P. S. Case No. 203 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
