JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sessions Trial No. 450 of 2017, arising out Deep Nagar P.S.Case No. 216 of 2016 registered under Sections 307, 323, 341, and 302 of the Indian penal Code and Section 27 of the Arms Act. Allegation in brief is that petitioner and one Ajit Kumar shot at the informant and Dharo Yadav causing fire arm injury on his chest and another fire arm injury to Dharo Yadav who died instantly sustaining injury.

Learned counsel for the petitioner submits that two persons are alleged to have shot, but who caused the death of Dharo Yadav is not specific and the injury sustained by the informant is simple in nature and there is case and counter case. Having considered the specific allegation against the
