The petitioners apprehend arrest in connection with Complaint Case No. 2107 of 2020 registered under Sections 147, 323, 354B, 379, 380, 386, 452, 504/34 of the Indian Penal Code and section 27 of the Arms Act. Later on, Sections 354 and 354B/34 of the Indian Penal Code were added. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to land dispute. Both the
Patna High Court CR. MISC. No.63572 of 2022(2) dt.09-01-2023 2/2 parties are agnate. In the instant case, the complaint case is filed after lapse of three days of the alleged occurrence. There is general and omnibus allegation against the petitioners. Further he submits that petitioners have no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Judicial Magistrate-I, Vaishali at Hajipur in connection with Complaint Case No. 2107 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
