2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 30(a) (c) of the Bihar Prohibition and Excise Act.
3. The case of the prosecution is that altogether 694.2 liters of Nepali country made liquor was recovered from a sugarcane field.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that nothing has been recovered from the possession of the petitioner. Patna High Court CR. MISC. No.64816 of 2025(2) dt.23-09-2025 2/2 ordinate Bench of this court vide order dated 12.09.2024 passed in Cr. Misc. No. 65822 of 2024 and as he could not surrender within the stipulated period of time, his regular bail has been rejected by the learned trial court. Moreover, the petitioner is languishing in judicial custody since 11.07.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of two cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bairgania P.S. Case No. 162 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court No.1, Sitamarhi.
