Patna High Court Cr.Misc. No.52523 of 2016 (3) dt.17-01-2017 2/3 Hilsa P.S.Case No.484/16 for the offence under Section 7 of the E.C.Act On the basis of allegation of some consumers that the petitioner who was a P.D.S.dealer was not supplying food grains the F.I.R. was lodged without verifying the stock and the register of the stock maintained by the petitioner.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The case diary does not reveal that the stock register or stock of the petitioner was ever verified as submitted by the learned counsel for the State. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties
