JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 356, 379, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged by the informant that unknown miscreants made an attempt to rob his motorcycle and fired from their pistol.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered
Patna High Court CR. MISC. No.63430 of 2022(2) dt.21-02-2023 2/2 from the conscious possession of the petitioner. The petitioner has not been put on T.I.P. The name of the petitioner surfaced on the confessional statement of coaccused Mahanand Kumar. The petitioner is languishing in custody since 28.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Nanpur P.S. Case No. 273 of 2022.
