JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-01-2017 This application is filed for Modification of order dated 27.03.2015 passed in Cr. Misc. No. 38612 of 2014. Learned counsel appearing on behalf of the petitioners submits that petitioners along with one Mahendra Mahto were granted Anticipatory Bail on 27.03.2015 passed in Cr. Misc. No. 38612 of 2014 with a direction to surrender before the court below within a period of four weeks pending in the Court of Judicial Magistrate, Motihari, East Champaran in connection with SC & ST (Motihari) P.S. Case No. 52 of 2014, but due to some unavoidable circumstances, petitioners could not surrender before the court below within the stipulated time. Further submission is that Mahendra Mahto, who was also one of

Patna High Court Cr.Misc. No.51729 of 2016 (3) dt.27-01-2017 2/2 the petitioners in Criminal Miscellaneous No. 38612 of 2014 has died.

In such view of the matter, the time to surrender of the petitioners as per order dated 27.03.2015 passed in Cr. Misc. No. 38612 of 2014 is further extended by two weeks from today in connection with SC and ST (Motihari) P.S. Case No. 52 of 2014, pending in the court of Judicial Magistrate, East Champaran, Motihari.

Accordingly, the modification application is allowed and the order dated 27.03.2015 passed in Cr. Misc. No. 38612 of 2014 is modified to the above extent.
