The three petitioners apprehend their arrest in connection with Begusarai Muffasil (Lakho) P.S. Case No.207 of 2015 for the offences punishable under sections 304(B) and 201/34 of the Indian Penal Code.
The petitioners have been charged for causing the unnatural death of the daughter-in-law who happens to be the daughter of the informant.
Learned counsel appearing for the petitioners with reference to the FIR has submitted that it is only for the relationship of these petitioners who are mother-in-law, sisterin-law and father-in-law that they have been roped in the
Patna High Court Cr.Misc. No.55149 of 2015 (2) dt.18-12-2015 proceedings on the basis of a generalized accusation of demand of dowry. He submits that the marriage took place in the year 2007 and to establish the same invitation-card was also placed before the court below but the same has been ignored and in consideration of the invitation card the offence under section 304(B) of the Indian Penal Code itself would become a suspect. Having heard learned counsel for the parties and considering the submission of learned counsel for the parties, let the petitioners, namely, Shanti Devi, Mamta Devi and Sagar Sharma in the event of their arrest or surrender within four weeks from today be released on bail upon each of them furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil (Lakho) P.S. Case No.207 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
