The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 506, 307, 354, 325 and 34 of the Indian Penal Code pending in the learned court below.
Allegation against the petitioner is that he along with other co-accused had assaulted the son of the informant by means of iron rod.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that there is case and counter case between the parties. He submits that as perusal of contents of
Patna High Court CR. MISC. No.63421 of 2022(2) dt.12-01-2023 2/2 FIR, it appears that allegation against the petitioner is general and omnibus in nature and there is no specific allegation the petitioner. He further submits that petitioner has got three criminal antecedent as stated in para-3 of the bail application. Learned APP for the State opposes for prayer for bail and submits that injury found upon the victim is grievous in nature, hence he does not deserve anticipatory bail. Considering the aforesaid facts and circumstances and the fact that injuries found upon the victim are grievous in nature, I am not inclined to enlarge the petitioner on bail in connection with Khagaria (Chitragupta Nagar) P.S. Case No.10/2022. Accordingly, his prayer for anticipatory bail is hereby rejected.
