JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-12-2016 Heard leaned counsel for the petitioner and the leaned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kawakola P.S. Case No. 91 of 2016, registered under Sections 341, 323,307,379, 504,506/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Nawada. The accusation is that due to land dispute occurrence took place in which petitioner caused grievous injury near the eye of the informant.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner to cause grievous injury, which appears from the order dated 14.11.2016 passed by the Addl. Sessions Judge, Nawada in A.P.B. No. 912 of 2016 rejecting the prayer of anticipatory bail, I am not inclined

Patna High Court Cr.Misc. No.53663 of 2016 (2) dt.20-12-2016 2/2 to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
