Petitioner is languishing in custody in connection with N.D.P.S. Case No.10 of 2016, arising out of Bhagwanpur P.S. Case No. 129 of 2016 for the offences punishable under Sections 25(1-B)a/26 of the Arms Act and Sections 22/23 of the N.D.P.S. Act.

According to F.I.R. one country-made pistol and one kilogram ganja were recovered from the possession of this petitioner. Petitioner is in custody since 09.06.2016. Para-3 of the bail petition shows that the petitioner is accused in some other serious cases. Learned counsel for the petitioner submits that in

Patna High Court Cr.Misc. No.53653 of 2016 (3) dt.13-02-2017 2/2 other cases the petitioner is on bail. No independent witness has witnessed the search and seizure.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail for the present. The bail prayer of the petitioner is refused. The learned trial Court is directed to expedite the trial. (Birendra Kumar, J) Mkr./- U T
