JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioners and the State. The petitioner no. 1 being brother of the husband of the complainant and petitioner no. 2 being brother of petitioner no. 1 are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323,379 and 498A/34 of the Indian Penal Code.
The basic accusation is of torture though it is alleged against the petitioners that they insulted the complainant and snatched gold ear ring. The specific accusation of causing burn injury is against the husband of the complainant.
Patna High Court Cr.Misc. No.3602 of 2016 (2) dt.22-01-2016 2/2 It is submitted by the learned counsel for the petitioners that the petitioners are separate from the husband of the complainant.
Considering the thrust of accusation against the husband of the complainant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Madhepura, in connection with Complaint Case No. 595 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
