JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-11-2017 Heard the parties.

This application, for grant of anticipatory bail, arises out of Lalganj P.S. Case No. 202 of 2017, disclosing offences under Sections 147, 148, 341, 323, 342, 307, 327, 353, 427 and 504 of the Indian Penal Code.

There is allegation against 17 persons named, in addition to 60-70 unknown persons, who are said to have caused obstruction in discharge of the official duty of the policemen and they were protesting against inaction of the police. They are said to have misbehaved with the police personnel and damaged the property.

Patna High Court Cr.Misc. No.48840 of 2017 (2) dt.17-11-2017 2/2 Learned counsel for the petitioner has submitted that strictly speaking, no case, under Sections 307 or 353 of the Indian Penal Code is made out, on the basis of what has been alleged.

Considering the nature of allegation, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 202 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself/herself before the police/Court, as the case may be, as and when required and in the event of failure on his/her part to appear before the Court on two consecutive occasions, his/her bail bond shall be liable to be cancelled.
