JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 380, 448 and 504 of the Indian Penal Code. Prosecution case is that on protest being made by the informant for abusing him, the accused persons assaulted the informant when informant's younger brother, Bhola Prasad, came to rescue he was also assaulted by the accused persons. It is alleged that the accused persons damaged the household articles and took away `2500/- kept in the box.
It is submitted by learned counsel for the petitioner that the injuries of the informant and his brother have been found to be simple in nature. The petitioner's side at earlier point of time,
Patna High Court Cr.Misc. No.56003 of 2015 (2) dt.09-12-2015 2/2 lodged Rajauli P.S. Case No. 56 of 2015 against the informant and others, wherein petitioner's side have also received injuries. Considering the case lodged by the petitioner's side at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Rajauli P.S. Case No. 57 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
