Mr. Anjani Kumar, AAG-4 ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE and HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 22-02-2018 Inter alia contending that under the Pradhan Mantri Aawas Yozana, benefits have been conferred to the persons contrary to the

Patna High Court CWJC No.15168 of 2017 dt.22-02-2018 2/3 scheme and persons selected by the agency have not been granted benefit, instead by removing the names illegally, the benefit is being conferred on individuals, who are not entitled for the same, and further pointing out that the officials are misusing their position and charging 50% of the amount officially from various persons, this writ petition has been filed.

Even though various allegations have been made, we find that under the Scheme, Annexure-A dated 24.06.2016, an elaborate procedure has been laid down for disbursement of the benefit under the Scheme and a Grievance Redressal Committee has also been constituted which is required to look into the same. Taking note of all these factors, for the present, we are not inclined to interfere into the matter. As the petitioner is making complaint with regard to illegalities committed in disbursement of the beneficial Scheme by the Government Officials, the petitioner may make up a detailed complaint with all specific details to the Chief Vigilance Department of the State Government or the Lokayukta Organization in the statutory prescribed form and Lokayukta Organization shall look into the grievance of the petitioner and cause enquiry, if called for, and proceed in the matter in accordance to law.

Patna High Court CWJC No.15168 of 2017 dt.22-02-2018 3/3 With the aforesaid liberty to the petitioner, the petition stands disposed of.
