The petitioner seeks bail in connection with Sitamarhi P.S. Case No. 40 of 2017 dated 18.01.2017 instituted for the offences under Sections 25(1-b) a, 26 and 35 of the Arms Act, 1959.

From the possession of the petitioner, one country made pistol and one live cartridge have been recovered. The petitioner is in custody since 19.01.2017. The petitioner was earlier made accused in a case under Section 302 of the Indian Penal Code but has been granted bail in the aforesaid case by a Bench of this Court. The other two accused persons from whom fire arms were recovered viz. Md. Akbar and Md. Anis have already been granted bail.

Patna High Court Cr.Misc. No.55543 of 2017 (2) dt.21-12-2017 2/2 Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner also. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S.
