The petitioners are languishing in custody since 29.9.2015 in a case registered for the offences punishable under Sections 20,22 and 23 of the NDPS Act.

The prosecution case is that from the house of Md. Munna alias Rummi 30.07 gm of smack and 182 gm of ganja were recovered. The petitioners and others were found present in the house of co accused Munna.

It is submitted by the learned counsel for the petitioners that admittedly recovery has been made from the house of co accused Munna. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the recovery has been made

No.263 of 2016 (2) dt.05-01-2016 2/2 from the house of co accused Munna, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge (Special Judge), Muzaffarpur in connection with Ahiyapur NDPS Case No. 917 of 2015.
