10 kg of 'Ganja' was recovered from the possession of the petitioner for which he is facing prosecution under Section 20( C), 22 and 23 of the N.D.P.S. Act.

It is submitted that the recovery was not made from the conscious possession of the petitioner. Some of the requirements of law in seizure have not been complied with. Learned counsel for the State opposed the prayer. Considering the nature of the allegation and other materials reflected from the record, the prayer for bail is rejected.
