Having regard to the fact that the order of this Court has been substantially complied with but the petitioner has made an issue on the basis of correspondence of the Regional Deputy Director of Education, Saran who was not required to take any cognizance of the order passed by the District Programme
Patna High Court MJC No.1833 of 2018(7) dt.31-10-2018 2/2 Officer (Estt.), Saran, the Regional Dy. Director of Education, Saran was asked to be present in Court. He has admitted that he has no direct concern with the implementation of the order in question. However, he has to be cautious in exercising his jurisdiction.
Considering the totality of the fact situation, the present contempt proceeding is dropped. Personal appearance of the Regional Dy. Director of Education, Saran is dispensed with. However, liberty shall be available to the petitioner if he is otherwise aggrieved by implementation of the direction of this Court by approaching appropriate forum/court in accordance with law.
