Petitioner, who is in custody, seeks bail in connection with Sandesh P.S. Case No. 123 of 2014, registered for the offence punishable under Sections 341, 323, 324, 326, 307, 498(A) and 34 of the Indian Penal Code.

Informant has alleged in his written complaint that informant solemnized marriage of his daughter with one Chootu Singh, who died, one year ago. Thereafter, the accused persons started assaulting and torturing the victim for the purpose of grabbing her share in the ancestral property. On 20.08.2014 in the night the accused persons assaulted the victim by sharp weapon with the intention to kill her, in which she sustained injuries.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case on

Patna High Court CR. MISC. No.59997 of 2019(3) dt.27-11-2019 2/3 account of family feud and he is brother-in-law (Dewar) of the victim. Two incised wound has been found on victim. The petitioner has no criminal antecedent and is in custody since 10.07.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with tow sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Bhojpur at Ara in connection with Sandesh P.S. Case No. 123 of 2014 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be property represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel his bail bond.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that
