JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 447, 341, 323, 504, 327, 307/34 of the Indian Penal Code. It is alleged that accused persons came variously armed in the background of land dispute when petitioner No. 2 Arjun Yadav and co-accused Vinod Prasad Yadav assaulted the informant by means of Tangi and Khanti on his head and when the mother of the informant came to rescue then she was being assaulted by petitioner No. 2. It is submitted by learned counsel for the petitioners that injuries of the informant and his mother have been found to be superficial, simple in nature, caused by hard and blunt substance. There is counter version of the occurrence and petitioners' side also received injuries.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 72 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
