2. The petitioners apprehend arrest in connection with Kazi Mohammadpur P.S. Case No. 121 of 2025 dated 28.04.2025 instituted for the offence punishable under Sections 329(4), 126(2), 115(2), 117(2), 117(3), 74, 303(2), 352, 351(2), 351(3), 3(5) of Bhartiya Nyay Sanhita.

3. The prosecution case, in short, is that on the alleged date of occurrence, the petitioners along with other accused persons threatened to break the canopy and building of the informant. Again on 3:15 pm, the petitioners came and entered into the house of the informant using filthy words to the informant

Patna High Court CR. MISC. No.63192 of 2025(2) dt.10-09-2025 2/3 and thereafter assaulted him. It is alleged that when the wife of the informant came, they snatched gold chain and assaulted her with iron rod. It is alleged that they also assaulted his brother-in-law.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that due to a dispute with regard to a passage, the said incident took place. Learned counsel for the petitioners submits that in the injury report of the informant, there is no mention about any external injury sustained by him. So far injury of Sudhir Kumar Verma, who is brother-in-law of the informant, is concerned, he sustained injury on the left wrist. In his injury report, it is mentioned that 'Fracture noted at distal end of radius with associated soft tissue swelling'. Learned counsel for the petitioners submits that the the said injury sustained by his brother-in-law is due to his fallen down. Lastly, it has been submitted that petitioners have no criminal antecedents.

5. On the other hand, learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioners.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Kazi Mohammadpur P.S. Case No. 121 of 2025, they will be released on bail upon

No.63192 of 2025(2) dt.10-09-2025 3/3 furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, (East) Muzaffarpur subject to condition as laid down under Section 482(2) of the B.N.S.S.
