Reference may be made to the order dated 18.07.2018 passed by this Court in presence of all the parties. Pursuant to the said order now the undertaking has already been filed on behalf of the petitioner wherein she has categorically stated her desire to maintain the victim girl, look after her pregnancy and to provide all safety and security of life to the victim girl.
Today, an affidavit has been filed on behalf of the
Patna High Court Cr. WJC No.1490 of 2018 (7) dt.01-08-2018 informant who is the father of the girl. In tune with his statements made before this Court in Chambers, he has stated that he has no objection if his daughter goes to reside permanently at the house of the petitioner as her daughter-in-law as he is not opposing the marriage. His concern is only about the safety and security of his daughter. He has, however, stated that he would not continue any relationship either with his daughter or any member of the family of the petitioner in any manner. It is stated that the petitioner should keep on informing the whereabout and wellbeing of the daughter of the informant to the concerned police station within whose jurisdiction she resides.
In the nature of the present case, having taken note of all aspects of the matter and the desire of the parties, this Court would direct release of the girl namely Ms. Anjali Kumari, daughter of respondent no.5, in favour of the petitioner Renu Devi. The victim girl, Ms. Anjali Kumari may go along with the petitioner and reside with her. The petitioner would be obliged to act in terms of her undertaking given before this Court. She should also keep on reporting about the whereabout of the victim girl to the concerned police station within whose jurisdiction she would be residing with the victim girl and such information should be furnished to the Officer-in-Charge of the concerned police station
Patna High Court Cr. WJC No.1490 of 2018 (7) dt.01-08-2018 periodically at the end of every three months. The compliance shall be continued till the victim girl attains the age of majority. The Court has been informed that the petitioner is presently residing within the jurisdiction of Ahiyapur Police Station at Muzaffarpur. The S.H.O of Ahiyapur Police Station, Muzaffarpur, is directed to accept the information furnished by the petitioner and shall also ensure from time to time that the victim girl is safe in the house of the petitioner.
