JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Earlier the prayer for bail of the petitioner was dismissed vide order dated 18.08.2018 passed in Cr. Misc. No. 49134 of 2018 and the case is under Section 302 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that he has been in custody since long and there is no likelihood of conclusion of trial in near future. Learned counsels for the State and informant opposed the prayer for bail.

Having heard both sides, considering the fact that there is allegation against the petitioner of giving iron rod blow on the head of informant and further he is a convict under Section 395 of the Indian Penal Code, as such, I am not inclined

However, since the petitioner has been in custody since 20.04.2018, the Trial Court is directed to expedite and conclude the trial as early as possibly.

This application is accordingly dismissed.
