The appellant seeks regular bail in G.R. no. 887/17 arising out of Amarpur (Fullidumar) P.S. Case No.125 of 2017 registered for the offence under Sections 147, 148, 149, 302 of the I.P.C., Section 27 of the Arms Act and Sections 3(2)(v) of SC/ST (POA) Act.

Allegation against the appellant along with other named co-accused persons having variously armed is of firing on younger brother of the informant causing his death.

Submission of the learned counsel for the appellant is that there is there is dispute between the family of the informant and uncle of the appellant. He is in custody since 8.5.2017. Heard learned Special.P.P. also assisted by the counsel

Patna High Court CR. APP (SJ) No.2832 of 2017 (3) dt.21-11-2017 2/2 for the informant who opposed the prayer for anticipatory bail. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the appellant. However, if substantial progress is made in the trial within a period of six months, the appellant will be at liberty to renew his prayer for bail which will be considered on the basis of materials available on the record and pass appropriate order without being prejudiced by this order.
