It has been submitted on behalf of the petitioner that he is not named in the F.I.R. Later on, one Bhogendra Kumar was arrested and in his confessional statement he has named this petitioner. Some recovery was made from the possession of Bhogendra Kumar and not from the petitioner. He is in custody since 14.7.2016 and has no criminal antecedent. Heard learned A.P.P. also. He has pointed out that petitioner was arrested on the spot.

Having heard both the parties and in view of the fact that petitioner has been made accused on the basis of confessional

No.55216 of 2016 (2) dt.10-01-2016 2/2 statement of the co-accused and there is no recovery from his possession, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Birpur, Supaul, in connection with Nirmali P.S. Case no. 75 of 2016.
