The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420, 384, 120B/34 of the Indian Penal Code.
The prosecution case is that the petitioner and one Ramnath executed sale deed with regard to purchase land of the informant in favour of several persons. It is submitted by the learned counsel for the petitioner that in fact, the informant purchased only part of the land of original survey plot no. 62 from the father of the petitioner in 1965 and he is co-sharer, but he got mutated the entire land. Title Suit No. 154 of 1990 is pending between the
Patna High Court Cr.Misc. No.306 of 2016 (2) dt.07-01-2016 parties. The petitioner ensures his share of land. Moreover, the informant has also file Eviction Suit No. 39 of 1991. Considering the nature of dispute between the parties and pending Title Suit, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Nagar P.S. Case No. 847 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
