The petitioner seeks bail in a case instituted under Sections 498(A)/302/34 of the Indian Penal Code. The allegation against the petitioner is of committing murder of the deceased due to non-fulfillment of the demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.07.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. In course of occurrence, the petitioner had also sustained injury. The informant vide Annexure-

Patna High Court Cr.Misc. No.54464 of 2017 (3) dt.27-11-2017 2/2 3 to the present application has filed a petition before the court below that due to mistake of fact, the present case has been instituted. Later on, he learnt that the petitioner had also sustained burn injury, in course of occurrence, while saving the deceased. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, J.M.Ist Class, Danapur, Patna, in connection with Maner P.S. Case No. 526 of 2016.
