JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-02-2023 Heard learned counsel for the petitioner, leaned counsel for the informant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.
As per prosecution case, the informant being second wife of the deceased, alleged that the petitioner who is first wife of the deceased, has blessed with one son namely, Md. Sajjad Alam. The co-accused Sajjad Alam was continuously in conflict term with the deceased for landed property and therefore, on dated 26.7.2021, when the informant and her deceased/husband were going to home, the petitioner along with co-accused intercepted and badly
Patna High Court CR. MISC. No.64864 of 2022(2) dt.24-02-2023 2/3 assaulted to the deceased and committed murder of her husband for landed property.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in the present case due to land dispute between the parties. The petitioner is a lady and she has no concern with the alleged offence. There is no specific allegation of committing murder of the deceased by pressing neck is against the petitioner rather general and omnibus allegation is leveled against her. The petitioner has got no criminal antecedent. She is languishing in judicial custody since 21.4.2022.
Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail and submitted that deceased was killed by the accused persons with intention to revenge. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Palasi P.S. Case No. 142 of 2021 on
Patna High Court CR. MISC. No.64864 of 2022(2) dt.24-02-2023 3/3 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Araria.
