The petitioner apprehends his arrest in Khajekala P.S. Case No.299 of 2016 under Sections 419, 420 and 376 of the Indian Penal Code.
The victim alleged that the petitioner was residing in his house as tenant for last ten years but taking advantage of penury condition of the victim, the petitioner established physical relation with her and later on, the petitioner also solemnized marriage in a temple and took the victim at different places. It is further alleged that the petitioner deserted her after being physically exploited.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.48119 of 2017 (3) dt.13-11-2017 victim is a widow. She demanded Rs. 5 lacs from the petitioner but when the petitioner did not oblige the victim, the false case is registered. It appears from the records that the petitioner took advantage of the poverty of the victim and physically exploited the victim.
Considering the nature of allegation made against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Saurabh/- U T
