2. The petitioners apprehend their arrest in a case in connection with C.A. No. 556 of 2020, registered for the offences punishable under Sections 323, 406, 465, 504, 506/34 of the Indian Penal Code.

3. As per F.I.R., allegation against the petitioners are that they illegally constructed a room in the courtyard of the rented house of the complainant and also assaulted the complainant and snatched gold chain etc.

4. It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.65757 of 2023(3) dt.22-01-2024 2/2 that the petitioners have falsely been implicated in the present case. Petitioners have got one criminal antecedent mentioned in Para 3 of the bail application. He further submits that the allegations made by the informant in the present case is forged and fabricated. The fact is that the petitioners have given Rs. 5,00,000/- to the complainant/tenant mentioned in Annexure-3 of the bail petition and agreement was made when they demanded the said money complainant filed the present case.

5. Learned APP for the State as well as learned counsel for the complainant have opposes the prayer for bail.

6. Having regard to the facts and circumstances of the case and also perusal of the records, it is a civil dispute between the parties, let the above named petitioners, be released on bail, in the event of their arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with C.A. No. 556 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
