2. The petitioner seeks bail in connection with Sikta P.S. Case No. 88 of 2024, instituted for the offences punishable under Sections 191(2), 191(3), 190, 103, 126(2), 115(2), 109 and 352 of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that while the informant and his family members were cultivating their paddy field, in the meantime, a tractor entered in his field and started damaging his paddy crops, on raising objection, the petitioner along with other co-accused persons assaulted them and inflicted lathi blow to informant's sister-in-law due to which she got unconscious. Thereafter, the injured was taken to the
Patna High Court CR. MISC. No.65575 of 2025(2) dt.16-09-2025 2/3 hospital for treatment, where the doctor declared her dead.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case and cognizance has also been taken against the petitioner. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the no specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. It is further submitted that specific allegation of hitting sister-in-law of the informant is against co-accused Balal Miyan. The petitioner is in custody since 09.07.2025 and has got no criminal antecedent. Learned counsel for the petitioner further submits that other co-accused has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 12.05.2025 passed in Cr. Misc. No. 5478 of 2025.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sikta P.S. Case No. 88 of 2024.
