KUMAR ORAL ORDER 17-10-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners, who are in custody, seek bail in connection with Mahnar P.S. Case No. 70 of 2016 registered for the offence punishable under Sections 147, 149, 341, 323, 307, 302, 504 of the Indian Penal Code.
The allegation against the petitioners and other accused persons are of abusing and assaulting the husband of the informant.
Learned counsel for the petitioners submits that allegations against all the petitioners are of general nature. It has further been submitted that for the similar occurrence FIR has also been lodged by the side of accused and there is injury also on side
Patna High Court Cr.Misc. No.48823 of 2017 (2) dt.17-10-2017 of accused. The dispute was regarding measurement of land and on account of this there was assault from both sides and the husband of the informant sustained injury and died while he was taken to hospital. It has further been submitted that petitioners have no criminal antecedent and for the same occurrence an FIR has also been instituted by one of the accused Ranjan Das and they are in custody since 17.12.2016.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VI, Vaishali at Hajipur, in connection with Mahnar P.S. Case No. 70 of 2016. (S. Kumar, J) veena/- U T
