KUMAR ORAL ORDER 17-10-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners, who are in custody, seeks bail in connection with Hajipur Town P.S. Case No. 502 of 2017 registered for the offence punishable under Sections 399, 402 and 414 of the Indian Penal Code and 25 (1-B) a, 26 and 35 of the Arms Act.

The allegation against the petitioner No.1 is that from his possession one live cartridge was recovered and from the possession of petitioner No. 2 one live cartridge and one sickle has been recovered.

Learned counsel for the petitioners submit that the

Patna High Court Cr.Misc. No.48832 of 2017 (2) dt.17-10-2017 petitioners are innocent and have committed no offence and have falsely been implicated in this case. It has further been submitted that petitioners have no criminal antecedent and they are in custody since 24.07.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No. 502 of 2017.
